Wedding Photo Contract

Client: Jay & Kathryn
The following is the agreement between the individual signing ("CLIENT") the "DIGITAL CONTRACT" and Sarah Heaton ("CONTRACTOR"), collectively as the "PARTIES." The Parties agree to the following:
1. Services. The Contractor shall provide their services to the Client as requested in the Digital Contract in exchange for payment as stated in the Digital Contract. The Contractor shall provide the Client the opportunity to request minor edits to images that require less than 1 hour of editing. Should edits be requested totaling more than 1 hour of work, an additional fee of $50/hr will be incurred. The contractor will inform the client of an estimate before proceeding with edits.
2. Time of Completion. The Contractor shall give the Client the Final Images no later than six weeks after the date of the event. The Contractor shall send any revised Final Edits out for delivery no later than fourteen days after the Client approves the Initial Final Images. The digital gallery will remain available to access forever. If the Contractor eventually must delete the gallery, they will notify the Client in advance before deletion.
3. Payment. A non-refundable 20% retainer deposit is due at the signing of this agreement, reserving the Contractor's services for the date requested. The remaining payment will be due the date of the event. The Contractor shall be paid by check, cash, or credit card via invoice. Additional costs may be applied if the production incurs added expenses not listed in the current agreement. These may include, but are not limited to, parking, additional crew, and specialty equipment. The Client must approve any and all added expenses, if applicable, before they are added to the final cost.
4. Ownership. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, will be the exclusive property of the Contractor. The images the Client receives are theirs to post and print, but not to reproduce or publish without explicit consent of the Contractor. Client agrees not to reproduce or modify the images or footage provided without first obtaining a formal written release signed by the Contractor. If Client is allowed to purchase Raw Images, they are not to publish the unedited images without specific request and confirmation from the contractor, for any reason.
5. Responsibility of Client. The Contractor may request to speak with the client or their coordinator prior to the event either over the phone or in person. The Client understands this communication will greatly benefit the final product and is highly encouraged. The Client or the Client’s coordinator must send a timeline no later than 3 days prior to the event date. Should a timeline not be sent, this contract becomes void and the Contractor is no longer required to arrive or record any part of said event.
6. Privacy. The Contractor shall only be allowed to post the Final Edits publicly if the Client permits it as listed in the Digital Contract.
7. Force Majeure. Should the time of the event need to be changed, the Contractor will make themselves available on the rescheduled date as long as the Contractor is not otherwise obligated and a $80 rescheduling fee will be applied. If the Contractor is not available on the rescheduled date, the Contractor will refund the balance, minus any deposit, to the client. If the Contractor is unable to provide services due to illness or injury, the Contractor agrees to make every possible effort to find the Client a suitable replacement or will refund the entire amount paid, both deposit and balance.
